General Terms and Conditions (GTC) – Vouchers el chipirón
1. Scope of Application
These General Terms and Conditions apply to all orders and purchases of vouchers made through the online voucher shop of
el chipirón – Tapas Bar & Restaurante, operated by magastro GmbH, Hamerlingplatz 2, 1080 Vienna, Austria (hereinafter referred to as “we” or “el chipirón”).
Deviating terms and conditions of the customer are not accepted.
These GTC apply exclusively to the purchase of vouchers via the online shop and not to restaurant visits or other services provided on-site.
2. Conclusion of Contract
The contract is concluded when the order process in the voucher shop is completed and confirmed by us (via email).
The voucher becomes valid only after full payment has been received.
3. Right of Withdrawal (Consumers only)
3.1. Customers who are consumers within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG) may withdraw from the purchase within 14 days without giving any reason.
The withdrawal period begins on the day the voucher is received.
3.2. To exercise the right of withdrawal, it is sufficient to send a clear declaration via email to info@elchipiron.at within the withdrawal period.
Any physical vouchers already received must be returned by post to our business address.
3.3. After the withdrawal period has expired, withdrawal is excluded.
The right of withdrawal expires prematurely if the voucher has already been redeemed (in full or in part).
4. Prices and Payment
4.1. All prices are in euros (EUR).
As the vouchers are value-only vouchers, VAT will only be charged upon redemption of the voucher (§ 11 para. 14 Austrian VAT Act - UStG).
4.2. Payment is made via the available payment methods in the voucher shop (e.g. credit card, instant transfer, PayPal, etc.).
The voucher is valid only after full receipt of payment.
4.3. Cash redemption of the voucher value is excluded.
If the consumption is less than the voucher value upon redemption, the remaining amount will be issued as a new credit voucher.
4.4. All vouchers are valid for 3 years from the date of issue. After this period, the right to redeem the voucher expires.
5. Delivery
5.1. Vouchers are delivered – depending on the selection – either digitally (via email as PDF) or physically (by post).
Additional shipping costs may apply for postal delivery.
5.2. We do not assume liability for delayed delivery via postal service.
6. Retention of Title
The voucher remains our property until full payment has been received.
7. Liability
7.1. We are liable only for damages caused by willful intent or gross negligence.
For slight negligence, we are only liable in cases of breach of essential contractual obligations, and only up to the amount of the foreseeable, typical damage.
7.2. Liability for loss of profit or other consequential damages is excluded.
Liability under the Product Liability Act remains unaffected.
8. Data Protection
8.1. We process personal data (name, address, email, payment data) exclusively for contract fulfillment and in accordance with applicable data protection laws (GDPR, DSG).
8.2. Data is only shared with our technical service providers (e.g. payment providers, Incert eTourismus GmbH & Co KG) for order processing.

9. Validity and Redemption
9.1. Vouchers can be redeemed only at the el chipirón restaurant, Hamerlingplatz 2, 1080 Vienna.
Partial redemptions are possible; any remaining balance will be reissued as a new voucher.
9.2. Vouchers are transferable and can be redeemed by any person who presents them.
10. Final Provisions
10.1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, the legal place of jurisdiction is their place of residence.
For business customers, Vienna is agreed as the place of jurisdiction.
10.2. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by a valid one that comes closest to the intended economic purpose.
